Terms of Service

1. Acceptance of Terms

By using or accessing WePub ("Service"), operated at wepub.top, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old to use the Service. By using the Service, you represent that you are at least 18 years of age.

2. Beta Status

The Service is currently in beta. Features, availability, and data retention are subject to change or discontinuation at any time without notice. We do not guarantee the preservation of any data, including articles, drafts, or account settings, during the beta period. You are responsible for maintaining your own backups.

3. Service Description

WePub is a multi-platform content publishing tool that allows users to draft, edit, preview, and manage articles for platforms including WeChat and X (Twitter). The Service also provides optional AI-powered content generation and rewriting features.

4. Account

You are responsible for maintaining the security of your account and all activity that occurs under it. You must notify us immediately of any unauthorized use. We are not liable for any loss arising from unauthorized access to your account.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Infringe on the intellectual property rights of others
  • Generate, distribute, or publish spam, misleading, or deceptive content using the AI features
  • Automate bulk publishing or use the Service for automated content farms
  • Harass, abuse, threaten, or incite violence against any individual or group
  • Attempt to reverse engineer, decompile, or disassemble the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Attempt to gain unauthorized access to the Service or its related systems

Violation of these terms may result in the immediate termination of your account.

6. Content Ownership

You retain all rights to the content you create using the Service. By using the Service, you grant us a limited, non-exclusive, royalty-free license to store, process, and transmit your content solely for the purpose of providing and improving the Service. This license terminates when you delete your content or your account.

7. AI Features

The Service offers AI-powered content generation and rewriting. These features are provided as creative assistance only. We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content.

You are solely responsible for reviewing, editing, and approving all content before publishing. We are not liable for any consequences arising from content you publish, whether or not it was generated or modified by AI features.

AI features have usage limits that vary by subscription plan and may reset daily or monthly. AI usage is non-refundable.

8. Bring Your Own Key (BYOK)

Free-tier users may provide their own OpenRouter API key to access AI features. When you provide an API key:

  • Your key is encrypted at rest using AES-256-GCM. We take reasonable measures to protect it, but we are not liable for key exposure beyond what results from our gross negligence.
  • Your AI requests are processed through OpenRouter and its underlying model providers. Your content is subject to their respective terms and privacy policies.
  • You are responsible for any charges incurred on your OpenRouter account.
  • You may delete your stored API key at any time through the Settings page.

9. Third-Party Platforms

The Service enables publishing to third-party platforms such as WeChat and X (Twitter). By using these features, you agree to comply with the respective terms of service and content policies of each platform. We are not responsible for any actions taken by third-party platforms against your content or account, including content removal, account suspension, or other enforcement actions.

10. Fees and Subscription

The Service offers free and paid subscription plans. Paid subscriptions are billed in advance on a monthly or yearly basis and renew automatically unless cancelled.

All fees are non-refundable. You may cancel your subscription at any time, and cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time.

We reserve the right to modify pricing. Price changes take effect at the start of the next billing period following reasonable notice.

11. Cancellation and Termination

You may cancel your subscription at any time through the billing settings. Cancellation takes effect at the end of the current billing period.

We may suspend or terminate your account at any time for violation of these Terms, non-payment, or any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.

During the beta period, we do not guarantee data retention after account cancellation or termination.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

13. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for all claims arising from or related to the Service shall not exceed the greater of the amounts you paid to us in the six (6) months preceding the claim or fifty U.S. dollars ($50).

14. Indemnification

You agree to defend, indemnify, and hold harmless WePub and its operators from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

15. Dispute Resolution

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in San Francisco, California, and may be conducted remotely.

You agree that any arbitration shall be conducted on an individual basis only, and not as a class, consolidated, or representative action. You waive the right to participate in a class action lawsuit or class-wide arbitration.

You may opt out of this arbitration provision by sending written notice to us within 30 days of first using the Service.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised effective date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

18. General

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force. Our failure to enforce any right or provision does not constitute a waiver. These Terms constitute the entire agreement between you and WePub regarding the Service.
